A CHARTER ORDINANCE EXEMPTING THE CITY OF BENTON, KANSAS FROM THE PROVISIONS OF K.S.A. 12-4112 AND AUTHORIZING THE ASSESSMENT OF CERTAIN COURT COSTS IN THE MUNICIPAL COURT OF BENTON, KANSAS.

Section 1: The City of Benton, Kansas, pursuant to the authority of the Constitution of this state, hereby exempts Benton, Kansas, from the provisions of K.S.A. 12-4112. In each case brought within the Municipal Court of Benton, Kansas, there shall be costs assessed to such party as the court shall designate to defray the administrative expenses incurred therein.

Section 2: Costs shall be fixed at a base amount as follows:

$20.00 - Traffic infractions including less than 25 miles per hour over posted limit.

$40.00 - Speeding over 25 miles per hour over the posted limit.

$60.00 - Serious traffic violations and all other misdemeanors.

Section 3: In addition thereto, court costs may include such additional amounts as may necessarily be spent to compel the attendance of witnesses, including expert witnesses, and may include such other expenses reasonably necessary within the discretion of the Court for the administration of justice. In addition thereto, costs authorized pursuant to the following statutes may be assessed:
